Diminished Value Claims in Virginia After a Car Accident

Diminished value is a potential loss in a vehicle's market value after an accident, even after repairs. A claim is not an automatic payment: liability, evidence, prior damage and applicable policy or legal rules matter.

If your car has been repaired after another driver's accident, you may wonder whether an accident history will affect its resale value. For Virginia drivers, it is important to separate the cost of repairing the car from a possible diminished value claim.

Repair cost and diminished value are different

Repair costs pay for work needed to address the damage. Diminished value concerns a claimed difference in market value that remains afterward. A vehicle can be repaired correctly and still have an accident history that a prospective buyer considers.

Not every accident produces a provable remaining loss. Age, mileage, condition, previous collisions, the severity of this damage and the quality of the repairs can all matter. A percentage taken from an online calculator is not, by itself, proof of what your particular vehicle lost in value.

Third-party claims versus your own insurance

A request to an at-fault driver's liability insurer is different from a claim under your own collision or comprehensive policy. Responsibility for the accident and the available evidence matter in a third-party claim. A first-party claim depends on the wording of your own policy; do not assume that repair coverage also pays diminished value.

Virginia's legal definition of diminished value appears in Code § 46.2-1600. That definition is not a promise that an insurer owes a particular amount in every case. Ask the insurer to explain its position and the evidence it needs. For advice about legal entitlement, disputed liability or deadlines, consult a Virginia attorney rather than relying on general online guidance.

Records worth keeping

Good documentation makes it easier to describe the accident, the repair and the vehicle's condition. Save records while the claim is active rather than trying to recreate them when you later sell or trade the car.

  • Photos showing the damage before repairs and any existing unrelated damage.
  • The initial estimate, supplements and final itemized repair invoice.
  • Relevant inspection, measurement or calibration records available for the repair.
  • Mileage, vehicle equipment, maintenance history and prior accident information.
  • Correspondence with insurers and a qualified appraisal if appropriate to the dispute.

How a body shop can help—and what it cannot promise

The body shop's role is to assess damage, perform the authorized repair and explain its documented scope. Superior Collision Center's structural repair service includes documentation of the work. Ask our team which repair records are available for your vehicle.

A repair shop does not determine your legal entitlement, guarantee a settlement or necessarily provide a diminished value appraisal. If a valuation opinion is needed, ask your insurer or legal adviser about an appropriate independent professional. Do not confuse an appraisal fee with a promise that the insurer will reimburse it.

We work with all insurance companies and are a direct repair facility for GEICO ARX and Erie Insurance. Our Manassas team can help with the collision repair process while any separate valuation dispute is handled with the insurer and appropriate advisers.

Frequently asked questions

Does Virginia guarantee a diminished value payment?

No automatic payment or universal amount is promised. Liability, evidence, policy terms and applicable law must be considered for the individual claim.

Does my own collision policy cover diminished value?

Do not assume it does. Review the actual policy and ask your insurer for its coverage position. Your own-policy claim differs from a third-party liability claim.

Can Superior Collision Center calculate my diminished value settlement?

We can discuss repair documentation, but we do not promise valuation or legal services. A qualified appraiser or Virginia attorney may be needed for a separate diminished value claim.
